What Colbert is pointing out here is that it is impossible for Sonia Sotomayor to be neutral because she isn't of the white race. Her background makes it impossible for her to become a neutral judge according to the other white judges. He also points out that being neutral here in america is to be white. It's proven by band-aids.
This satire makes a true racial problem easier to swallow.
Satire well done makes a problem visible - Colbert has become a real master of staire - we laugh while we are uncomfortably aware!
